DUI and Other Charges

DATE & TIME:  Tuesday, May 7^th, 2019 at approximately 10:00 A.M.

LOCATION: HWY 136 & Penrod St. Beatrice, NE                  

OFFENSE: DUI and Other Charges

On 05/07/2019, at approximately 10:00 A.M., Gage County Sheriff’s Deputies, Gage County Sheriff’s Investigator along with assistance from the Beatrice Police Dept., conducted a traffic stop at Hwy 136 & Penrod St. of a 2008 Saturn driven by Herbert Coleman, 43 years of age of Omaha, NE. Prior to the stop Deputy Chavez observed Coleman’s vehicle cross the center line on three occasions, plus other minor traffic violations. Coleman’s driving behavior was reported by another motorist as being unable to maintain his vehicle in the lane of travel and speeding on HWY 136 near the Gage County and Jefferson county line. The traffic stop investigation resulted in finding Coleman’s driver’s license suspended. Also, Coleman was showing signs of impairment. After further investigation, Coleman was placed under arrest for DUI. Coleman refused to submit to a Preliminary Breath Test and Chemical Test. Coleman was transported to the Gage County Detention Center where he was booked and lodged. Deputy Chavez applied for and was granted a search warrant of Coleman’s blood by blood draw. Coleman was presented with the search warrant and he refused the order. The Sheriff’s Office was later notified that the vehicle Coleman was operating was taken without the vehicle owner’s permission out of Jefferson County.

Coleman was charged with the following: N.R.S. 60-4108(2) Driving under Suspension, N.R.S. 60-6-196 Driving under the Influence, N.R.S. Refusal of Preliminary Breath Test 60-6,197.04, N.R.S. Refusal of Chemical Test 60-6,197.03(6), N.R.S. 28-901 Obstructing Government Operations, N.R.S. 28-516 Unauthorized use of Propelled Vehicle & N.R.S. 60-6,131 Driving Left of Center.
